In the state of California one is available for up to 12 weeks of Paternity Leave, however only under the following three conditions:
1. Worked for the current employer for at least 12 months.
2. Must have been active for 1,250 hours for the 12 months preceding the leave.
3. Under the NPLA (New Parent Leave Act), one needs to be attached to an employer with at least 20 employees in a 75-mile radius.
If these demands are met, then the employee will be eligible for the much needed time off with a newborn.
How much Is Paid Paternity Leave California Allowed?
In California, there are currently no paid Paternity Leave laws in place, yet employees can communicate with their management in order to see if there is a possibility of paid time off or sick leave payment to help with monetary needs during the Paternity Leave. The state demands that 55% of wages are paid for the first six weeks of leave. For those who make one-third of the average salary will get 70% for this time, but there is a maximum of $1,173 in full payment.

The FMLA laws in California allow for time off during and after pregnancy to bond with a child. Employers with more than 5 employees can allow for up to for months of disability caused by pregnancy, however, this time is determined by the healthcare provider.
FMLA also allows for Baby Bonding Leave, which is for any newborn or adopted child within the year of entering the household. This is up to 12 weeks of unpaid time off with job security. It is also in addition to the Pregnancy Disability. Paternity leave is done by the employer, but FMLA is supported by federal laws and regulations.
What is EDD of Paternity Leave California?
The California EDD (Employment Development Department) handles the issue of PAID Family leave. According to the website of California EDD, To be eligible for California PFL benefits, you must:
• Have welcomed a new child into the family in the past 12 months either through a partner’s pregnancy, adoption, or foster care.
• Have paid into State Disability Insurance (noted as “CASDI” on pay stubs) in the past 5 to 18 months.
• Not have taken the maximum six weeks of PFL in the past 12 months.
Can a Father Use his Short term disability for paternity leave?
Short-Term Disability is available to one who is unable to work due to a disability and has lost money because of it. One is only eligible after receiving at least $300 in wages. These state laws will also assist in pregnancy disability which can begin 4 weeks before birth and up to six weeks after. All created to give new parents a more relaxed beginning to their child’s life.
